ERC MEMBER TERMS AND CONDITIONS.
In these ERC Member Terms & Conditions (defined below), "Emancipated Run Crew" and “ERC” means the running and fitness community that is Emancipated Run Crew CIC, a registered community interest company with company number 13983012; “ERC Event” means an event organised by or on behalf of ERC; “ERC Event Leader” means an ERC Member or third party who is leading or responsible for managing an ERC Event; “ERC Event Rules” means the rules governing ERC Events as set out in Clause 6 to 12 of these ERC Member Terms & Conditions, and as supplemented or amended in the relevant ERC Event registration page on the Heylo App and/or any third party app which ERC uses to host ERC Event registrations/ticket sales; "ERC Member(s)" means the individual registering to become or who has registered as a member of ERC (accessing either the ERC Run Free Member Tier (such person being a “ERC Run Free Member”) or the ERC NRG Member Tier (such person being a “ERC NRG Member”), with each ERC Member tier as set out in Clause 3 below); "ERC Member Requirements" means the member requirements set out by Emancipated Run Crew that all ERC Members and/or Event Participants agree to abide by when becoming an ERC Member and/or when attending or participating in an ERC event; "ERC Member Terms & Conditions" means these terms & conditions which governs the relationship between ERC and the ERC Member / Event Participant; ; “Event Participant” means the person who has registered to attend or purchased tickets for an ERC Event (and will include any ERC Members who have registered to attend or purchased tickets for an ERC Event); the “Heylo App” means the platform you are agreeing to this terms of service on, owned by Piccup, Inc (trading as “Heylo”).
2. MEMBERSHIP REGISTRATION.
All ERC Members are required to agree to these ERC Member Terms & Conditions on the Heylo App in order to register for membership of ERC. All ERC Members are required to include a photograph in their Heylo App profile and failure to provide this may result in them being denied membership. ERC is an identity-based group which exists to encourage and support underrepresented individuals who identify as Black, Brown or people of colour in grassroots running. ERC reserves the right to deny registration or remove members who do not meet these criteria. All ERC Members agree to abide by these ERC Member Terms and Conditions and the ERC Member Requirements, and failure to do so may result in them being suspended or ejected from the community entirely.
3. MEMBERSHIP & BENEFITS.
3,1. ERC has two membership tiers:

3.1.3. The ERC NRG Member Tier. ERC NRG Members are asked to make a contribution of £49 per year to ERC (the “ERC NRG Membership Contribution”), which provides access to the following benefits:

Access to community spots / discounted spaces / ballots for various organised race events: e.g. London Marathon, London Winter Run, London Landmarks, Hackney Half, The Big Half

Priority access to ERC Events (ERC managed events)

3.2. Paid membership is for a 12-month cycle and Members can sign up anytime throughout the year. ERC Members can select which tier is best for them and can change or cancel their membership directly in the Heylo App at any time. The Heylo App will record the appropriate billing date for ERC NRG Members and automatically bill for the future billing date for the ERC NRG Membership Contribution.
3.3. ERC NRG Members will have a 7-day free access period before being required to pay the ERC NRG Membership Contribution. ERC reserves the right to change the benefits of each tier and the ERC NRG Membership Contribution at any time.
3.4. Please note: the ERC NRG Membership Contribution is non-refundable and membership is not transferable to anyone else.
4. ERC CODE OF CONDUCT.
4.1 ERC prides itself on being a welcoming, safe space, open to all who identify as Black, Brown or any person of colour. We respect the rights, dignity and worth of every person and shall treat everyone equally and equitably, regardless of age, sex, disability, gender reassignment, race, religion, sexual orientation, pregnancy/maternity, civil partnership/marriage and wider characteristics (e.g. socio economic status). ERC is committed to building an environment where everyone has the right to participate in running and fitness in an environment free from threat of intimidation, harassment and abuse. All ERC Members and Event Participants have a responsibility to oppose discriminatory behaviour and promote equality of opportunity.
4.2. ERC has a zero-tolerance policy to offensive or inappropriate behaviour in our community, whether on the Heylo App or at ERC Events. This includes but is not limited to:

Intimidation

Verbal Abuse
-
Physical Violence
-
Sexual, Physical, or Verbal harassment
-
Disrespectful Behaviour
4.3. All ERC Members & Event Participants should behave accordingly. We will deal with any incidence of discriminatory behaviour seriously according to our disciplinary procedures. Consequently, ERC reserves the right to impose appropriate penalties for a breach in conduct which include and are not limited to a temporary suspension from ERC Events and/or ERC Membership; and/or removal from the ERC community on Heylo App, and full revocation of ERC Membership.
4.4. Complaints or reports of inappropriate or unacceptable behaviour should be reported to a member of the ERC Leadership Team via Heylo, or directed via the feedback section in the Heylo App or notified to ERC through contacting info@emancipatedruncrew.com .

5. VOLUNTEERING.
ERC is run by volunteers, and giving back to the running and movement community is also at the core of what we do and is something ERC is passionate about. Volunteering is not mandatory; however, ERC strongly encourages its members to participate in volunteering activities when asked. This could be anything from handing out water to fellow runners at a race, to helping organise ERC Events.
6. EVENTS.
ERC timetables, ERC Event Leaders and ERC Events are subject to change at any time. ERC will endeavour to provide notice when an event is unable to take place for any reason. ERC Members and Event Participants must book in advance to ensure that an ERC Event has space for them, as some ERC Events may have limited capacity. All ERC Members and Event Participants must comply with any reasonable request from ERC Event Leaders in relation to health and safety, and to ensure smooth running of an ERC Event. ERC Event Leaders are volunteers, and any disrespect of ERC Event Leaders will not be tolerated.

7. EVENT REGISTRATION.
Event Participants at ERC Events are required to register and accept these Event Rules via the ERC Event registration page within the Heylo App prior to attending an ERC Event (or where ERC is using a third-party app to manage registration or ticket sales for an ERC Event, any terms and conditions or waivers as required by ERC in any such third-party app). If Event Participants do not sign up for an ERC Event via the Heylo App (or any other third-party app ERC uses to manage the registration of an ERC Event) prior to the ERC Event they will not be allowed to participate in or attend the ERC Event. Participation is at ERC’s absolute discretion, and availability may be restricted. ERC reserves the right to charge a fee for ERC Events at their discretion. Where required, all Event Participants are required to provide photographic identification, and failure to provide this may result in them being denied entry to the ERC Event. All Event Participants agree to abide by these Event Rules, and failure to do so may result in them being ejected from the ERC Event or (where the Event Participant is an ERC Member) from the ERC community entirely.
8. BAG DROP AND LOST PROPERTY.
Bag drop is only offered for certain ERC Events and ERC reserves the right to limit it to ERC Members only. ERC takes no responsibility for loss, theft or damage for any items brought by our ERC Members or Event Participants during ERC Events and emphasise that ERC Members and Event Participants leave their belongings, when a bag drop is available, at their own risk.
9. PHOTOS.
During ERC Events, photos and videos may be taken for use on ERC, and its affiliates’, sponsor(s’)/(‘s) and third-party vendors’ marketing channels and social media. By attending our events you agree that these can be used by ERC, and its affiliates’, sponsor(s’)/(‘s) and third-party vendors’.
10. AGE.
Unless accompanied by an adult, only those aged 18 and over can participate in ERC Events. Proof of age may be required.
11. HEALTH AND SAFETY.
ERC Members and Event Participants take full responsibility for any injury or health condition sustained whilst partaking in ERC Events. Event Participants and ERC Members also take full responsibility for any injury or health condition sustained whilst participating in ERC Events arising from a previous medical condition. ERC Event Leaders are not medically trained and are therefore not qualified to assess whether the Event Participant or ERC Member is in appropriate physical condition to attend our Events. ERC advises all Event Participants to take medical advice prior to starting any exercise programme if they are in any doubt as to their ability to do so. All ERC Members and Event Participants must comply with any reasonable request from ERC Event Leaders in relation to health and safety, and to ensure smooth running of ERC Events. If any ERC Member or Event Participant has concerns in relation to health and safety, they must report the issue to ERC Event Leaders immediately.
12. RISK.
A risk assessment will be undertaken for all ERC Events to ensure all ERC Events are sufficiently safe. As such ERC takes no responsibility for participants or member actions during an ERC Event and, subject to Clause 11, provides no liability cover for those participating. Members and Participants take part in ERC Events at their own risk.
13. LIMITATION OF LIABILITY.
Nothing in these Terms & Conditions shall limit or exclude the ERC liability for: (i) death or personal injury caused by its negligence, or the negligence of its personnel or agents; (ii) fraud or fraudulent misrepresentation; or (iii) any other liability which cannot be limited or excluded by applicable law. Subject to that: (a) ERC and its affiliates, sponsor(s) and third party vendors shall have no liability to the ERC Member or Event Participant, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any indirect or consequential loss arising under or in connection with these Terms & Conditions; and (b) ERC and its affiliates’, sponsor(s’) and third party vendors’ total liability to the Member or participant, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, arising under or in connection with these Terms & Conditions shall be limited to the amount paid or payable for the ERC NRG Membership Contribution.
14. YOUR PERSONAL INFORMATION.
ERC takes the responsibility for looking after ERC Members' personal information very seriously, and the ERC Privacy Policy, available at https://www.emancipatedruncrew.com/privacy-policy sets out how we collect, use and store your personal information. ERC Members are responsible for advising ERC of changes to their personal information. ERC will never sell your personal information to any third party.
15. CHANGES TO ERC MEMBER TERMS & CONDITIONS AND ERC MEMBER RULES.
ERC may from time to time amend these ERC Member Terms & Conditions and/or the ERC Member Rules, including the introduction of any additional terms and conditions and rules and will notify ERC Members of changes to the ERC Member Terms and Conditions by placing a notice on their page on the Heylo App. Any changes will be effective immediately and the new terms will also be made available on the ERC website.
16. THE TERMS OF ERC MEMBERSHIP.
These ERC Member Terms & Conditions and the ERC Member Requirements set out the terms of membership with ERC. ERC Members are advised to read these ERC Member Terms & Conditions and ERC Member Requirements in full before indicating acceptance on the Heylo App. By indicating that you accept these ERC Member Terms & Conditions, you are confirming that you have read, understood and accept the ERC Member Terms and Conditions and ERC Member Requirements. The failure of ERC to enforce any of its rights at any time for any period shall not be construed as a waiver of those rights. Any failure to identify or act upon a breach of the ERC Member Terms & Conditions or ERC Member Requirements shall not be deemed to be an affirmation by ERC that the behaviour of the ERC Member is acceptable.

17. GOVERNING LAW AND JURISDICTION.
These ERC Member Terms & Conditions, and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-agreement disputes or claims), shall be governed by, and construed in accordance with the laws of England and Wales. Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these ERC Member Terms & Conditions or their subject matter or formation (including non-agreement disputes or claims).
